RENTAL RULES
Kayak or paddle board rentals may not be taken off-site.
Must be 18. years or older to rent.
Children under 13 must be accompanied by an adult at all times.
Life jackets must be in use during kayak or paddleboard activities.
GENERAL LIABILITY RELEASE
Water Craft, Equipment rental agreement made between InTent Camping Consulting and Renter herein called InTent. UNDERSIGNED- herein called the RENTER, the person(s) using the rental equipment. WATER CRAFT- herein means the paddle board(s), and kayak(s) being rented. EQUIPMENT- herein means the associated equipment being rented such as (but not limited to) helmets, life jackets, paddles, and seats. 1 Renter shall obey all state and local boating regulations, and all lawful directives from appropriate emergency or law enforcement personnel while operating a Water Craft rental. In the event of a citation for violation of these rules the renter shall be solely responsible. Renter agrees to immediately notify InTent Camping of any incidents or injuries occurring while renting the Water Craft(s), and/or Equipment. 2 Renter represents that he or she is capable of operating the equipment and finds it in good working order, condition and repair at time of rental. InTent Camping Agreement 3 Renter shall bear all risk of damage or loss of personal property, InTent Camping equipment or any portions thereof, including but not limited to damage or theft, and shall pay InTent Camping the cost of repair or replacement of InTent Camping equipment. 4 RECOGNITION OF RISK; Renter expressly acknowledges that use of Water Crafts is an activity with inherent risks of injury to persons and property; Renter is aware of those risks and understands them. Renter acknowledges that life jackets are made available for use while renting a water craft, and that all participants are required to wear life jackets while operating a rented water craft. Renter understands that use of a life jacket does not remove all risks of injury; nor does it make kayaking, paddle boarding or paddle boating a safe activity. Renter alone has determined the sufficiency of any safety gear or other precautions that Renter decides to take to minimize the risks of the activity. No party related to InTent Camping, including Owner and Employees, has made any representations regarding the safety of, or the risks of, the activity. Renter expressly assumes the risks of the activity. 5 RELEASE OF LIABILITY; Renter hereby RELEASES InTent Camping, its owner, volunteers and its employees from liability for negligence, and HOLDS HARMLESS InTent Camping, its owner, volunteers and its employees from any loss, expense or cost, including attorney fees, arising out of any damages or injuries, whether to persons or property, occurring as a result of the rental or use of said equipment. This agreement constitutes the entire agreement between InTent Camping and Renter and no term may be waived or modified (including this provision against oral modification) except in writing signed by both parties. There are no warranties, expressed or implied, by InTent Camping to Renter, except as contained herein, and InTent Camping shall not be liable for any loss or injury to Renter nor to anyone else, of any kind or however caused. This agreement is one of bailment only and Renter is not InTent Camping agent while using said Equipment. The laws of the State of California in the County of El Dorado shall govern this agreement.
InTent at Montauk
InTent Consulting, LLC/Hold Harmless Agreement
The InTent Camping Consulting, LLC/Hold Harmless Agreement (the “Agreement”) governs the undersigned use of the vacation rental property operated by InTent Camping Consulting, LLC (InTent).
1. Eligibility Requirements/Your Responsibilities.
I represent and warrant to InTent that I am 18 years of age or older.
2. Services.
InTent agrees to provide one or more of the following services: rental of one or more campsites, equipment rental, special event venues, and/or special programs.
3. Informed Consent.
I acknowledge and agree that I am making an informed decision and have been given all necessary and relevant information to make that decision. I consent to obtain the service(s) of InTent and its representatives.
Limitations of Liability, Indemnity. I understand services provided by InTent carry risk. Despite the risks, including any negligence on my part which results in property damage, I voluntarily agree to expressly assume all risk of injury, harm (to self or property), or illness associated with my stay at Montauk. I agree to release from liability, agree never to sue, and agree to defend, indemnify and hold harmless InTent, its owners, staff, landowner, and members (collectively identified as indemnified parties) for injury, harm, damages, claims, lawsuits, liabilities, costs (including attorney’s fees) and expenses occurring to myself or third parties resulting from or relating to InTent services to the fullest extent allowed by law, including active, passive or sole negligence of the indemnified Parties.
Understanding the nature of the risks posed, I accept full responsibility for medical expenses, injury, damage to property, and any subsequent claims. If, any provision of this Agreement, is deemed unenforceable or in violation of law, such enforceability or violation will not affect the remaining provisions of the Agreement, which will continue in full force and effect and be binding upon the parties hereto. I agree that the Agreement is governed by the laws of the State of California without regard to choice of law rules. The venue for any dispute shall exclusively be El Dorado County.
I understand the risks of the services set forth above, that I am not under the influence of drugs or alcohol, and I am assuming these risks. I consent to receive services offered by InTent and agree to all the terms set forth above.
